Connecticut streamer Warren Pandisia has filed a class action lawsuit against Twitch and Amazon over the fact that both companies use live streams by default to train their artificial intelligence models, Engadget reports.

The complaint accuses Twitch and Amazon of failing to obtain a license or permission before using Twitch streams and videos as “a dataset necessary to support Amazon’s artificial intelligence products.”

Twitch previously made an official statement, including on social media, that streamers now have the option to opt out of “using channel content to train Amazon’s generative artificial intelligence models.” Creators must opt out, rather than agree to have their streams used to train the AI.

We’ve added a setting that lets you opt out of having your channel content used to train generative AI content models across Amazon.

When asked why streamers would have to opt out rather than opt in, Twitch Chief Product Officer Mike Minton said that “if it were consensual, no one would agree.”

The lawsuit alleges that Twitch and Amazon violated users’ rights by using their content as “free educational material for certain commercial artificial intelligence products.”

It also says that both companies benefit from streamers who “lost money or property as a result of illegal, unscrupulous, and fraudulent activities.”
