Nintendo’s fight against emulators continues, and we’re now hearing that in just one day, the company has taken down over 400 repositories.
Seven DMCA anti-circumvention were filed at GitHub. With that, more than 400 emulator repositories were targeted. Copies of the Suyu emulator, Yuzu forks, and Skyline were impacted. Most of these code repositories are now offline.
Nintendo primarily targeted Suyu, and since the reported network was larger than 100 repositories, GitHub processed the notice against the entire network, which covered 311 repos. The other notices pertain a lone repository as well as networks of a few dozen, including the independent Skyline emulator.
Nintendo’s argument for going after these repositories is as follows:
The reported repositories offer, link to, or otherwise provide access to Nintendo Switch emulators. Nintendo Switch emulators are primarily designed to play Nintendo Switch games. Specifically, these Nintendo Switch emulators illegally circumvent Nintendo’s TPMs in order to run illegal copies of Nintendo Switch games.
Nintendo Switch games are encrypted using proprietary cryptographic keys (prod.keys) which protect against unauthorized access to and copying of the copyrighted games.
During operation, the emulators at the reported repositories necessarily use unauthorized copies of these cryptographic keys to decrypt unauthorized copies of Nintendo Switch games, or ROMs, at or immediately before runtime without Nintendo’s authorization.
Thus, they are primarily designed to and unlawfully ‘circumvent a technological measure that effectively controls access to a work protected under’ the DMCA, and distribution of these emulators constitutes unlawful trafficking in technology that is ‘primarily designed or produced for the purpose of circumventing a technological measure that effectively controls access’ to copyrighted works.
You may remember that Nintendo was suing the creators of Switch emulator Yuzu in 2024. After that, the Discord servers for Switch emulators Suyu and Sudachi taken offline. We also saw Nintendo shutting down Ryujinx. All of these moves happened during the same year.
Additionally, this year, Nintendo seemingly went after every Switch emulator and fork on GitHub. However, it looks like it only took a few months for things to be built back up given the latest news.
