Therefore, NOAA did not include these individuals in the lawsuit … in the expectation that ordinary discovery … would reveal the identity and location of these actors.
However, because Williams allegedly evaded Nintendo’s attempts to serve him and then failed to appear in court, Nintendo argued in its filing that this meant they were unable to find those identities through discovery and were therefore seeking a subpoena.
